(Scroll down for video) A man was arrested and charged with murder after shooting and killing a young man because he pulled into his driveway, according to police reports in Georgia.
Police said the man, 69-years-old from Atlanta, faces a murder charge after authorities said he shot and killed a man, 22-years-old, who had pulled into his driveway.
Gwinnett County jail records showed that Phillip Walker Sailors, was arrested on a charge of murder after the shooting Saturday night in Lilburn, northeast of Atlanta.
The court documents state that 22-year-old Rodrigo Abad Diaz, of Duluth, was shot in the head while trying to get away from Sailors’ home.
Sailors’ attorney, Michael Puglise, told the local newspaper that his client was home with his wife late at night and mistook the young man who came to his home as a home invasion in progress.
Puglise said that Sailors was defending his home and maintains his innocence.
Lilburn Police refused to give further information on the circumstances of the shooting.
