The 50-year-old man from St. George is in trouble after he allegedly found his unconscious neighbor on her front porch and allegedly stated that he had sex with her to try to get her warm.

Rodger William Kelly told police that he did it with the 29-year-old, because “he was trying to save her life,” according to court documents.

He said he inserted it in order to try to get her temperature up, police wrote in their report.
Police told Kelly that his actions were rape. He was charged Monday with one count of felony rape in the first degree.

Kelly told officers he had found the woman in front of her apartment and took her inside his apartment, changed her clothes and put her in bed. He said he then lied down beside her and hugged her to try to get her temperature up because she had been out cold, and then tried to have sex to warm her.

When police arrived in response to a call, they found Kelly in his apartment giving the woman CPR.
The woman later told police she thought she might have been raped. She told police she had bruises on her thighs and upper pelvis, according to court documents.

The hospital was unable to complete a rape kit because the woman’s vaginal area was cleaned while sedated, according to court documents.

Kelly told police that the two were previously close, but admitted that the woman had said before the incident that she did not want to have sex with him.Mobile video not loading? Click here to view
