(Scroll down for video) A man was arrested, charged and convicted of theft related charges after failing to pay his $70 restaurant bill, according to court proceedings in Illinois.
The man was accused of running up a $70 bill in Illinois before telling the server he could not pay.
Prosecutors said that Anthony Malabehar, 47, had been out of jail for only 60 days before committing the crime. He was previously jailed for a similar offense. He ordered a meal for $70 at the Alamo Steak House in Mattoon and later told the server that he does not intend to pay.
“he said with a smile on his face, ‘I have to tell you a secret, I have no money,’” Alamo general manager Alex Schmink said.
State Assistant Attorney Rob Scales of Coles County said that Malabehar served a 60 day jail sentenced for eating at another restaurant before telling the server he would not be able to pay his $100 bill.
Malabehar has at least 13 previous convictions for theft or robbery and about 70 prior arrests on charges of theft.
Scales said the sentence was longer than usual because Malabehar’s extensive criminal record. Malabehar could be eligible for release in one year on good behavior credits.
