Woman mistakenly kept 5 months in jail despite being sentenced to just 48 hours

(Scroll down for video) A woman found herself in a nightmare situation after she was kept in jail months after she was supposed to be released.

The Indiana woman is thinking of filing a lawsuit against the county that arrested her after she served more than 100 days in jail.

Destiny Hoffman, 34, was sentenced to 48 hours in jail after tempering with a drug test and violating her drug treatment program. Five months later, Hoffman was still in jail.

This all happened after a judge told the Clark County Sheriff’s Department to keep Hoffman in jail until further order of the court.

The court order never arrived.

Hoffman was finally released after a prosecutor reviewed old files and found that the woman was still in jail. Her imprisonment has been considered illegal and it could result in a civil trial.
