Man jailed for sexual assault after poking hole in condom that caused his girlfriend to get pregnant

(Scroll down for video) A man will spend time in jail after he deliberately made a hole in a condom while having consensual sex.

The Canadian Supreme Court upheld the conviction of a man, who deliberately broke the condom while having sex with his girlfriend.

Craig Jaret Hutchinson of Nova Scotia, will spend the 18 months in prison for manipulating a condom, which resulted in his girlfriend getting pregnant.

Hutchinson wanted to save his relationship with his girlfriend, thinking he could do so by getting her pregnant.

His girlfriend did indeed get pregnant. In a series of text messages, Hutchinson told her what he had done. The woman then called the police and had an abortion.

He was charged with one count of sexual assault. The issue in court was whether he sexually assaulted the woman by having unprotected sex, to which she never agreed.

In 7 to 0 decision, the Supreme Court ruled that Hutchinson deprived the woman of her ability to consent to unprotected sex. “The defendant sabotaged the condom, which constituted a fraud. A person has the right to consent to how they want to be touched,” the judges said in their ruling.
