An alleged child rapist of the United Kingdom, received a temporary reprieve after his trial was canceled when his defense attorney caught the judge, who was presiding over the trial, sleeping while the child was testifying.
Prosecutors said that the trial collapsed when the defendant’s lawyer discovered that Philip Cattan fell asleep while the young girl was being questioned through a video link.
When asking for a mistrial, the lawyer argued that the judge missed vital evidence in the case against his client. Cattan decided to abandon the trial and dismiss the jury.
The case will be reheard by a different judge. It is estimated that this will cost the taxpayer an extra $17,000.
During the trial at the Manchester Crown Court, 49-year-old John Quigley, was accused of sexual assaulting two young girls. Cattan of Cheshire, is being investigated by the Bureau of Investigation of Judicial Conduct.
