(Scroll down for video) A man was arrested for sexual assault after kissing a girl on the mouth, which is against the law in Virginia.
21-year-old Erick Alezndro Hernandez Tellez, is the first person to be charged with sexual assault for “penetrating the mouth of a girl.”
In 2008, a law was passed, which made it illegal for an adult to use the tongue while kissing a child. The “French Kiss” law was signed by the then Governor Tim Kaine.
Police arrested Tellez for sexual assault after the 12-year-old girl told police that Tellez kissed her.
Telez was accused of violating Virginia Code 18.2-370.6, which states that anyone 18 years or older may not kiss a child under 13 in the mouth.
The bill was introduced on behalf of a mother who was upset when a man French kissed her young daughter in a daycare setting and felt that the punishment was not harsh enough.
Telez claims that he never met the girl alone only in a group setting. He also said that police came to his home to arrest him after he and his alleged victim’s boyfriend got into a fight.
He said he believed the teenage girl and her boyfriend made up the story to get him in trouble. Telez is being held without bail.
