(Scroll down for video) A family is outraged after a judge ordered an alleged violent murderer to be released on house arrest.
Philip Martin, 25, of Albuquerque, New Mexico, was accused of beating an elderly man to death, robbing him and then using the victim’s credit card.
Martin has been held in jail for the past four months on bail of $100,000 cash only.
However, District Court Judge Christina Argyres ordered him to be released under house arrest with an ankle monitor.
“It scares the whole family,” Eduardo Garcia said. Garcia is the son-in-law of 65-year-old Richard Zarate, who was beaten to death.
Police arrested five suspects including Martin, who has 31 charges against him.
Stacey Ward, who is representing Martin, claimed that he had nothing to do with the murder and that he was at the house to help a couple move their belongings.
Ward said that Martin he has no criminal record, not even a traffic ticket. She said that there is no evidence that he was involved in the crime.
