(Scroll down for video) A Burger King manager was accused of assaulting a customer who complained about cold onion rings, according to court documents filed in New Mexico.
Francisco Berrera, who worked as a manager at the Burger King in Bloomfield, pleaded guilty to felony assault with a deadly weapon in connection with the assault against Robert DeYapp.
Now, DeYapp is suing Berrera and Burger King, for the incident that left him shaken. The incident began when DeYapp ordered onion rings and they were served cold.
He took them back to the counter and ask if it could be reheated. Berrera took the onion rings and then told a coworker, “this white boy is mad about his food.”
DeYapp refused the food and asked for a refund, but the manager refused his request. DeYapp returned to his seat to finish eating.
That is when Berrera started taking pictures of him and his car. DeYapp asked Berrera what he was doing. In response, Berrera approached DeYapp with a Taser in one hand and a knife in the other hand.
Police arrived and arrested Berrera. DeYapp is seeking punitive damages for assault, and negligent hiring and training.
