(Scroll down for video) A popular rapper and his attorney are shocked after prosecutors filed gang related charges for singing gang songs.
Brandon Duncan of San Diego, California, likes to rap about gang life.
Duncan, also known as Tiny Doo, recently released an album named “No safety.” On Friday, Duncan and 14 members of a gang, were in court on charges of attempted murder.
They are accused of a conspiracy involving 9 local gang shootings.
A California law allows prosecutors to charge gang members if they benefit from crimes committed by other members of the same gang.
Duncan, who has no criminal history, has not been linked to the shootings. However, prosecutors argued that he benefited from the shootings because it allowed him to sell more albums.
Constitutional experts believe that it is not possible to charge Duncan, because it violates his right to freedom of expression.
