A truck driver was arrested, charged and convicted of reckless driving for smashing into a vehicle after watching adult videos on his mobile phone, prosecutors in the United Kingdom said.
26-year-old John Kirk of Glen Drive in Boston, was sleep deprived and fell asleep before causing the fatal incident on a busy highway.
He veered off the A19 and crashed into two other drivers who were exchanging data on the side of the road after being involved in a minor accident.
Andrew Nimmo of County Durham and Lada Khazanovych of Darlington, suffered serious injuries when Kirk crashed into Khazanovych’s Ford Focus.
Nimmo, 24, died at the scene, while Khazanovych, 38, suffered serious leg injuries.
According to the police investigation, Kirk, who had two previous convictions for using a mobile phone while driving, had slept only four hours in the 31 hours preceding the incident.
Kirk falsified records to remain above the minimum weekly rest periods. Mobile phone records showed that he had made a phone call while driving despite not having a hands free device.
He also accessed adult websites twice during the trip.
Kirk, who was traveling just above the speed limit of 50 miles per hour, told police officers at the scene that was falling asleep.
Kirk pleaded guilty to causing death by dangerous driving, causing serious injury by dangerous driving and falsifying records.
Kirk was sentenced to serve five years in prison and was banned from driving for 5 years.
