(Scroll down for video) A group of drivers filed a class action lawsuit against a Canadian province for not doing enough to protect drivers from moose on roads, according to court documents filed in Newfoundland and Labrador.

According to the plaintiffs in the lawsuit, the provincial government is at fault for injuries suffered from crashing into moose walking on roads.

“If the government would have controlled the moose population there would be less accidents,” the lawsuit states. However, Judge Robert Stack dismissed the lawsuit on Friday morning.

The provincial government was found not responsible for the moose vehicle collisions.

The judge said that the plaintiffs did not prove gross negligence by officials, as a result, the government is immune from a negligence claim.

The government applauded the judge’s decision. However, the attorney for the plaintiffs said that he intends to appeal the court's decision.

The government said that it might build a fence to protect roadways from wild moose.
