(Scroll down for video) A father and a mother were arrested on charges of assault after the father allegedly shot his baby while cleaning his gun, prosecutors in New York said.
Brooklyn District Attorney Ken Thompson announced that the 47-year-old man has been indicted on second-degree assault and other charges for accidentally shooting his 9-month-old daughter in his Brownsville home while cleaning his gun.
The child’s mother has been indicted for second-degree reckless endangerment.
“This father could have easily killed his innocent and helpless baby. This behavior was completely irresponsible and now both parents will be held accountable,” District Attorney Thompson said.
Pedro Rosales, 47, and Jessica Aguilar, 24, of 580 Sutter Avenue in the Brownsville section of Brooklyn, were arraigned before Brooklyn Supreme Court Justice Miriam Cyrulnik on an indictment in which Rosales is charged with second and third-degree assault and criminal possession of a firearm.
He and Aguilar are both charged with second-degree reckless endangerment and endangering the welfare of a child. If convicted, Rosales faces up to seven years in prison and Aguilar faces up to one year in jail.
Rosales was ordered held on $100,000 bond or $50,000 bail and Aguilar was ordered held on $10,000 bail or $5,000 bond.
According to the police investigation, approximately 3:30 p.m., Rosales was cleaning his unregistered, loaded .45 caliber firearm and it discharged, striking Jessica Rosales, his daughter, who was nine months old at the time.
The baby’s mother, Jessica Aguilar, was also at home at the time.
They took the baby to a nearby hospital where she was admitted for a gunshot wound that entered her left hip and exited her back.
Aguilar told police that she lied to hospital staff about how the child came to be shot. Police later recovered the .45 caliber firearm and a bullet fragment from the apartment.
