(Scroll down for video) A judge in Oregon, is drawing criticism after ruling that a man was allowed to take upskirt photos of a young girl in public.
Washington County prosecutors charged 61-year-old Patrick Buono, of invasion of privacy and attempting to encourage child pornography, but the judge dismissed the charges.
On Thursday, Judge Eric Butterfield ruled that Buono did nothing illegal when he took upskirt photos of the 13-year-old girl who was shopping at Target.
Buono admitted using his cellphone to take upskirt pictures of the girl, arguing that the law does not give people an expectation of privacy in public places such as retail stores.
He also said that the photos were not pornography because the girl was wearing underwear and he did not engage in a sexual activity.
The father of the girl, William Hergenhan, slammed the judge’s decision, saying that any normal person would say that what Buono did was not right.
