An elderly man suffered severe injuries after a boy kicked a soccer ball into the road, where he was riding his motorcycle, according to court documents in Japan.
Following the accident, the elderly man filed a lawsuit against the child’s parents, demanding compensation for his medical bills.
However, the Supreme Court ruled that the parents of the child are not responsible for the motorcycle accident that occurred after their son kicked his soccer ball out into the street from the school’s grounds.
A lower court ruled that the parents are responsible for the accident.
The lower court in Osaka, ordered them to pay 11,800,000 yen ($980,000) in damages to the family of the elderly man who was injured in the accident.
The Supreme Court ruled that parents are not responsible for the acts of a child, which caused injury or death by accident, provided that they committed acts not considered dangerous.
The accident occurred in Imabari, Ehime, when the 80-year-old man crashed his motorcycle while trying to avoid the soccer ball, which the 11-year-old child kicked in his direction.
The man became bedridden and died of pneumonia 18 months later.
