A child rapist received a lenient sentence because the young victim is gay, a court in Argentina ruled.
Now, the two judges who handed down the lenient sentence, have been heavily criticized by child advocates.
Mario Tolosa was originally sentenced to serve 6 years in jail for raping a 6-year-old boy, but his sentenced was reduced to 3 years because the boy had been raped by others.
The judges ruled that the defendant’s actions cannot legally be considered seriously outrageous because the child was clearly gay.
Gay rights groups are now demanding that the judges be removed from the court, saying that the ruling treats the victim as a criminal.
One of the two judges, Horacio Piombo, defended his decision.
Piombo said that before the child was sexually abused by Tolosa, the child had suffered at the hands of his own father, and as a result, the child had shown signs of a transvestite behavior.
He also said that the ruling was intentionally leaked to the public in order discredit him and his colleague, Benjamin Ramon Sal Llargues.
The boy’s father was sent to prison by another court.
