(Scroll down for video) A restaurant was slapped with a lawsuit for kicking out a woman after being mistaken for a man, according to court documents filed in Michigan.
The incident unfolded at the Fishbone’s Rhythm Kitchen Cafe in Detroit, when Cortney Bogorad tried to use the ladies room after eating dinner with her friends.
Bogorad claimed that she was injured after a security guard physically pushed her out of the restaurant. Bogorad is demanding compensation of $25,000 for civil rights violations and intentional infliction of emotional distress.
Bogorad said that after she paid for her food, she went to use the women’s bathroom, and while she was in the bathroom, she heard someone shout that a man entered the bathroom.
Bogorad ignored the shouting because she was not sure who was being addressed. Moments later, the security guard came into the bathroom and again shouted for the man to leave the bathroom.
Bogorad told the guard that she is a woman. Bogorad offered to show identification to prove herself, but the guard didn’t care.
The guard put his hands on her shoulders and aggressively pushed her out of the restaurant.
Bogorad suffered physical injuries, including bruises, wrist injuries, shoulder injuries and scars that required medical treatment.
