Father walks free despite confessing to raping his 5-month-old daughter

(Scroll down for video) Prosecutors in Missouri, were horrified to learn that a judge freed a man who was facing life in prison.

Aaron Michael Fisher of Jefferson City, will not face any prison time after confessing to raping his 5-month-old daughter because he did not get a speedy trial.

Prosecutors said that Fisher, delayed his trial several times over the years before suing for dismissal on grounds that he was not given a speedy trial.

Fisher was arrested in 2009. Fisher was charged with two counts of forcible sodomy for raping his 5-month-old daughter.

He was held in prison without bail ever since.

Last year, Fisher confessed to sexually assaulting the girl and pleaded guilty to the charge in exchange for life in prison with the possibility of parole.

However, he changed his plea a few months later, as he was about to be sentenced. His public defender said that Fisher pleaded guilty because he was frustrated with the system.

Cole County Circuit Judge Patricia Joyce agreed with fisher that he was not given a speedy trial. Now, Fisher was freed just one month before he was set to go on trial.

Former Prosecutor Matt Howard said that his office began building a case against Fisher in 2010. However, it was hard to coordinate the witnesses and Cole County only has two circuit court judges, making trials difficult to schedule.

When the prosecution was ready to go to trial in 2011, Fisher’s attorney motioned for a continuance and had the trial postponed.

That attorney has since retired and Fisher’s new attorney also asked for more time and therefore, things got delayed, according to the prosecutor’s office.

After being jailed for 6 years without bail, Fisher walked out a free man. Prosecutor Ben Winfrey is planning to appeal the judge’s decision.
