The maker of Similac baby formula was slapped with a lawsuit after allegedly using non-organic ingredients in baby formula labeled as organic, according to court documents in New York.
The lawsuit was filed in federal court on behalf of parents in New York and California.
The plaintiffs claim that 26 of the 49 ingredients of Similac Advance Organic made by Abbott Laboratories, are not permitted to be placed in organic foods.
One component includes genetically modified foods, in violation of federal organic standards. The parents are seeking more than $5 million in damage.
The company is accused of using false and misleading labeling to realize substantial profits.
Abbott denied the allegations, saying that the formula is in compliance with organic standards set by the U.S. Department of Agriculture.
