A judge told a man that he would like to wring his neck for blaming his victim for being raped.

40-year-old Fausto Bonifaz of Brooklyn, New York, admitted to having sex with the 12-year-old girl, but said that he is not guilty because the victim seduced him.

Bonifaz later pleaded guilty to coercing and enticing a minor to engage in sexual activity.

Over the course of a year, he sexually assaulted the girl on a weekly basis at the victim’s home at the Fort Hamilton Army Base.

Bonifaz was a civilian who was admitted to the base as a visitor because he was friends with the victim’s mother who worked with him at a Kohl’s department store. The girl’s father was on active military duty overseas, prosecutors said.

The defendant’s actions were uncovered years later, when the victim reported the abuse to a counselor.

Bonifaz insisted that he never pursued the victim, but it was she who enticed him when she entered his bedroom where he stayed while visiting her mother.

Brooklyn Federal Judge Raymond Dearie said that Bonifaz’s wife was pregnant at the time when he sexually assaulted the girl.

“Part of me wants to wring your neck. The idea that you were seduced by the victim is one of the most outrageous things I have ever heard in my courtroom,” Dearie said during sentencing.

Bonifaz was sentenced to 12 and a half years in prison.
