(Scroll down for video) A police officer in Illinois, shocked the family of a dead 19-year-old college student by filing a lawsuit against the man’s estate, demanding $10 million for extreme emotional trauma.
Officer Robert Rialmo of Chicago, said that he shot and killed Quintonio LeGrier, because he feared for his life.
LeGrier was in possession of a baseball bat and swung it near the head of the officer before being shot.
The father of the college student filed a wrongful death lawsuit against the city and the police officer, saying that his son was not a threat.
Rialmo also killed 55-year-old Bettie Jones, but police said that her death was accidental.
According to Rialmo, when he arrived at the house located on West Erie Street, LeGrier came to the front door with a baseball bat in his right hand.
Rialmo was standing at the front door, and LeGrier took a full swing at the officer, missing the head by inches. Rialmo repeatedly shouted at LeGrier to drop the bat, but the teen followed him to the porch and took another swing.
Rialmo continued to back off, but LeGrier came within 3 feet of the officer. Rialmo feared that the teen would hit him on the head with the baseball bat so hard that he would kill him.
Rialmo drew his gun from its holster and start shooting. He fired eight rounds at LeGrier. LeGrier was shot in the left side of his chest.
One bullet passed through LeGrier and struck Jones. Rialmo is suffering extreme emotional trauma, the lawsuit states. The father of LeGrier, claims that his son was inside the building when he was shot.
He also alleges that his son did not present an immediate threat to anyone before the shooting.
