A man who was charged with drug possession, was slapped with the maximum allowed sentence after telling a judge that God gave the right to smoke marijuana, according to court documents in Texas.

The Odessa Police Department said that they have arrested Canuto Jason Tarango, after being pulled over in the 4200 block of North Golder Avenue for having a defective license plate.

During the traffic stop, a marijuana cigarette was found on his lap.

Police then found a number of bags containing marijuana in the vehicle. When asked if he had more drugs, Tarango said that he had a bag of marijuana in his underwear.

Tarango did not want to be touched by law enforcement officers and pulled the bag out from under his pants while handcuffed.

During a search in jail, prison officers found another bag containing marijuana under his private parts.

In court, Tarango told the judge that he should not be prosecuted because of his religious beliefs, and the Bible gives permission to smoke marijuana.

He also claimed that smoking marijuana is a God given right.

However, a jury found Tarango guilty of possession of marijuana. He was sentenced to two years in prison, the maximum allowed under state law.
