A mother wants $40 million from people who attended a party for failing to protect her drunk daughter.

The mother of New York, is suing the owners of a house in the Hamptons and 100 unidentified guests because they did not realize that her daughter drowned in a pool.

29-years-old Olya Lipina, who was an illustrator and a graphic designer, died during an all night party. Her body was found only around noon the next day, floating in the pool.

He death was ruled accidental. Now, her mother, Alla Lipina-Skyba from Brooklyn, has filed a civil lawsuit.

However, she is not only suing the homeowners, Daniel and Linda Finer, and Laura Edith Kreft, but she is also suing the 100 party goers, claiming that they were negligent by allowing her daughter to get so drunk.

A friend called 911 when she found Lipina in the pool, but it was too late. She was confirmed dead when paramedics arrived.

The lawsuit states that the hosts and party goers failed to respond or seek help for Lipina. It also claims that the defendants “knew or should have known that Lipina was intoxicated or was getting drunk when she entered the pool.”

The plaintiff is suing the hosts and party goers jointly for wrongful death, personal injury, conscious pain and suffering. She wants $10 million for each cause of action.
