A man who sexually assaulted a woman, claimed that the victim approached him and pushed his hand into her underwear.
The incident began when the suspect was waiting outside a bar in Australia, to spy on his girlfriend because he thought she was cheating on him.
While waiting, Anjan Shrestha, 29, spotted a woman who he never met in person, but recognized her as one of his Facebook friends.
Shrestha decided to follow the victim, who was with her friends. He watched as she and her friends walked home at 2:00 a.m.
Soon, the victim decided to stop to get some food at a kebab shop while her friend’s went to a home nearby.
When she exited the shop alone, Shrestha called out her name and attacked her. He then penetrated the woman with his fingers.
The judge heard that Shrestha grabbed the victim, pushed her to the ground, mounted her by straddling her, and called her names, and said that she was his Facebook friend.
Shrestha maintained his innocence and said that it was consensual. He claimed that the victim walked over to his car and said that she recognized him.
He said that she kissed his neck and then pushed his hand into her underwear before suddenly screaming for him to get away. She then ran to her friend’s house, where she called police.
Shrestha was found guilty of one count of rape in Victoria's County Court.
He was sentenced to six years in prison and he was ordered register as a sex offender for eight years. He will also likely be deported to Nepal.
