Man stabs IHOP waiter because the food had poison

(Scroll down for video) A man was arrested on a charge of battery after allegedly stabbing a waiter because the food had poison, according to police in Florida.

North Miami police said that they have arrested 36-year-old Gene Henry Hicks, after being accused of stabbing an IHOP waiter because he became sick after eating the food he was served.

In court, Hicks pleaded not guilty to one count of aggravated battery with a deadly weapon.

According to the criminal complaint, Hicks bought waffles on Friday morning, at the IHOP located at 12875 Biscayne Boulevard.

Later in the day, around 3:30 p.m., Hicks returned to the restaurant and claimed that he was poisoned. He pulled out a knife and stabbed the waiter who served him in the morning.

The Miami-Dade Fire Rescue took the waiter to the Jackson Memorial Hospital's Ryder Trauma Center, where he is being treated for a non-life threatening stab wound.
