(Scroll down for video) Police in Florida, were called after a man was found with a gunshot wound to his chest.

Officers were told that 23-year-old Joaquin Mendez, was shot by a stray bullet on Saturday at 10:00 p.m.

Mendez was rushed to a hospital, where he died. A witness came forward and told police that the shooting was deliberate.

According to police, the witness said that Mendez was sitting on a chair when he put on a bulletproof vest and said that he wondered whether it “still worked.”

Mendez's cousin, 24-year-old Alexandro Garibaldi, replied: “Let's see,” according to the witness.

Garibaldi grabbed a gun and shot at the bulletproof vest, but it did not work, and Mendez was hit in the chest and died from his injuries.

Bulletproof vests have a shelf life and they do expire, according to the manufacturer. Some people, including police officer, said that they use bulletproof vests after the expiration date and they work just fine.

Some people speculate that the manufacturer add expiration dates for liability reasons. However, in the case of Mendez, the expired vest no longer worked and it proved to be fatal.

Police found the vest with bullet holes inside the home, and Garibaldi was arrested on charges of manslaughter and being a felon in possession of a firearm, police said.
