(Scroll down for video) A father killed a boy after he mistook him for an intruder when in fact his daughter snuck the man into the home after midnight.

Police in Georgia, were called to a home for a robbery. When they arrived, officers learned that the homeowner shot a boy who was hiding in a closet in his guestroom.

According to police, the homeowner, heard noise in middle of the night. He got up, grabbed his gun and he went downstairs, where the noise was coming from.

It was about 2:40 a.m., when Dereck Fulton walked to the room and warned the intruder that he was armed. He ordered the intruder to come out of the room.

As the father entered the room, 17-year-old Jordan Middleton ran out of the closet where he was hiding, and Fulton shot him. The teenager died of his injuries.

The father was shocked to learn that Middleton was not an intruder, but rather his 14-year-old daughter snuck him into the home after her parents were asleep.

So far, Fulton was not charged as Georgia is a stand your ground state.

The law also allows one to use force to defend their home. If a homeowner believes that someone entered their home to commit a crime, they can use force to prevent it.

Police said that the teen was hiding in the closet, and this may have provided that belief.

This law may also block Middleton’s family from suing the homeowner for wrongful death.

Police said that an autopsy will determine how far Middleton was when he was shot. This piece of evidence is crucial for detectives to determine if Fulton told them an accurate account of the incident.
