(Scroll down for video) A court case has caused controversy after a man was convicted of raping a woman after having consensual sex with her.

In the historic landmark ruling in Lausanne, Switzerland, a court concluded that removing a condom during sex without consent from the partner is considered rape.

The 47-year-old unidentified man from France was in Switzerland, where he met a woman through the dating app Tinder.

After a number of dates, the woman invited the 47-year-old man to her home, where they had sex. However, at some point, the man removed his condom without her permission.

The woman only learned that he did not wear condom when the sex session ended. She was furious and felt violated. The woman called police and the man was arrested.

The woman told the court that she would have refused to have sex if she knew that he was not wearing a condom.

The man was found guilty of rape and received a 12-month suspended prison sentence.

According to Alexandra Brodsky, the act of removing a condom during sex has become a new trend, which is known as “stealthing.”

Brodsky details stealthing in a report she did for Columbia Journal of Gender and Law, after she conducted a study on the practice and said that the act may violate several civil and criminal laws.

According to reports, straight and gay men recently began encouraging others on social media to remove their condoms during sex and telling them how to get away with it.
