Judge suspended after granting bail to man accused of raping mother and attempting to rape her minor daughter

A judge in India, was suspended from his position for allowing an accused rapist to be free on bail without considering the danger he posed to the victims.

The Allahabad High Court ordered judge Om Prakash Mishra, to be suspended over the “haste” shown in granting bail to an official who was accused of rape.

Former Uttar Pradesh minister Gayatri Prajapati, 49, was campaigning to be re-elected to the Uttar Pradesh Legislative Assembly, when he was accused of being part of a group of seven men who gang raped a woman and attempted to rape her 16-year-old daughter.

After the Supreme Court ordered the state police to file a case against him, Prajapati went missing. Police launched a manhunt and located Prajapati in Lucknow.

When he was brought to court, judge Mishra immediately granted him bail despite the fact that he is a danger to the victims.

The High Court also said that Prajapati tried to mislead the courts by concealing facts in his bail application.

Prajapati stated in his bail application that he had no criminal history when in fact he had six pending cases against him.

Prajapati lost his election bid and he was remanded back into custody.
