(Scroll down for video) Police in Texas, are promising not to give special treatment to a suspect who choked a man in front of his wife and child.

The incident began when 24-year-old Johnny Hernandez, was outside a Denny's restaurant in Houston, with his family.

According to witnesses, Hernandez was urinating on the street when an off-duty police officer arrived to the restaurant with her family.

The police officer's husband, who has not been named, became upset when he saw Hernandez urinating in full view of his children.

The officer’s husband confronted Hernandez, and an argument broke out. According to police, Hernandez, who was drunk, punched the officer’s husband.

That is when according to workers at the Denny's restaurant, the officer’s husband placed Hernandez in a chokehold, held him down and punched him over the head repeatedly.

Workers said that they and Hernandez’s wife begged the officer's husband to stop punching him. After about 10 minutes, workers said that Hernandez stopped moving, but the officer's husband still held him in a chokehold.

Meanwhile, the police officer stood there and watched her husband beating Hernandez, and she did nothing to stop the attack.

According to police, the officer performed CPR after Hernandez stopped breathing. Hernandez was declared brain dead at the hospital. He died two days later.

The Harris County Sheriff's Office, which is where the officer works, questioned the officer’s husband before allowing him to walk free. So far, no charges have been filed in the case. The officer will also continue her job while the investigation is ongoing.
