(Scroll down for video) A woman who killed her newborn baby, will not have to spend day in prison, according to police in Kentucky.

Louisville police said that a janitor at a Kohl’s department store made a horrific discovery while changing the garbage bags in the bathroom.

The employee found a newborn baby in the trash can and called police. Police and emergency workers arrived at the scene, but the baby could not be saved and was pronounced dead at the scene.

After an investigation, police discovered that the baby’s mother was an employee at the store. She left work for two hours and later returned to find police officers waiting for her.

The mother, Jessica Price, 32, has been arrested and charged with murder after she gave birth to the baby girl in the Kohl’s department store bathroom and then threw the body into the trash can, police said.

According to the police report, the baby appeared to be born full term and healthy, but died as a result “of an intentional act.”

Police have not revealed how they discovered that the baby belonged to Price, but she ended up admitting to police that she hid her pregnancy from co-workers and then got rid of the baby.

Shockingly, Jefferson Circuit Judge Olu Stevens sentenced the baby killer to probation, saying that he believes that the mother will never do such a thing again.
