Thief rapes married woman after she woke up to use the bathroom during burglary

A man was sentenced to 25 years in prison for raping a woman while her husband was sleeping.

In a plea deal with prosecutors, 27-year-old James S. Wimmer of Kokomo, Indiana, pleaded guilty to rape and burglary after he raped the married woman, held her and her husband at gunpoint, and robbed them.

Additionally, Wimmer was ordered to register as a sex offender.

According to court documents, Wimmer and 22-year-old Devan Lampe broke into the couple’s home. Lampe knew the couple, according to police.

The woman told police that she woke up at 2:00 a.m., to use the bathroom, and she realized that someone had touched her purse and its contents were on the floor.

Suddenly, two masked men confronted her. Wimmer went on to rape the woman while her husband was asleep on a recliner in the living room.

When the husband woke up, the men then forced him and his wife into a closet at gunpoint. The couple stayed inside the closet for about 30 minutes, until the armed robbers left.

The men wanted money for drugs, according to police. Detectives collected DNA from the woman. It came back as a match to Wimmer, and he was arrested. During questioning, he told police that Lampe was his accomplice.

Lampe pleaded guilty to burglary and was sentenced to 16 years behind bars, while Wimmer was sentenced to 25 years for the burglary and 16 years for the rape. Both sentences will run concurrently.
