A mother in California, announced that her son is planning to sue a good Samaritan who stopped him from robbing a Starbucks.

Pamela Chimienti of Fresno, said that she and her family do not condone what her son did, but she feels that the good Samaritan used excessive force on her son.

The incident unfolded when 30-year-old Ryan Flores, went into the Starbucks near Herndon Avenue and Highway 99.

His face was covered with a Transformers mask as he walked over to a barista, and pulled out a knife and a gun.

He held a yellow shopping bag and ordered the woman to hand over the money from the register.

Cregg Jerri, 58, who was sitting at a table with his drink, witnessed the incident. He got up, grabbed a chair and beat the armed robber over the head.

A fight ensued, and Flores stabbed Jerri in the neck. Jerri managed to grab the knife and stabbed the armed robber a few times until he managed to get him under control.

Chimienti claims that her son had 17 stab wounds, lacerations, and defensive wounds.

When police arrived, they arrested Flores on a felony attempted robbery charge.

The video of the entire violent incident was uploaded to the Internet, and police called Jerri a hero for stepping in and stopping the armed robber from hurting anyone.

However, his mother saw things differently. Chimienti said: "The guy, in my opinion, went from a good Samaritan to a vigilante."

She claims her son who was a "victim too," plans on filing a lawsuit against the good Samaritan for using excessive force.

Police chief Jerry Dyer said that it is clear from the video that Jerri feared for his life and that he acted in self defense. No charges were filed against him.

"To say that Cregg Jerri is going to be sued for intervening in an armed robbery and being stabbed in the neck, is ludicrous," Dyer said.
