A father was allowed to walk out of court a free man despite being accused of raping his preteen daughter and getting her pregnant, according to police in West Virginia.
Cabell Circuit Judge Paul T. Farrell sentenced Michael Joe Adkins to 5 years probation and 50 years supervision.
If Adkins violates the terms of his supervision, he could face up to 50 years in prison.
Judge Farrell said that he hopes Adkins screws up so he could send him to jail for his horrendous crime against this daughter.
Judge Farrell’s hands were tied as Adkins agreed to a Kennedy plea on one count of incest.
Adkins’ wife, Amanda Rea Adkins, pleaded guilty to child neglect for not stopping her husband from abusing her stepdaughter.
She was sentenced to 18 months probation and 10 years of supervision.
According to the police investigation, Michael repeatedly had sex with his 11-year-old daughter in their home.
When the girl became pregnant, he forced her to have an abortion.
The abortion clinic did not report the apparent case of statutory rape to the police.
The girl told the court that until this day, she is afraid to go to the bathroom because her father might be waiting inside to rape her.
