A teenager cut a deal with prosecutors after she was accused of raping a young man at knifepoint.
18-year-old Lestina Marie Smith of Saginaw Township, Michigan, got into a dispute with a 19-year-old man over the existence of a sex tape.
The man allegedly had a sex tape of the two engaging in sex acts while dating for two months and he threatened that he was going to put it out on social media, according to Smith’s attorney James Gust.
Smith wanted to make a sex video with the man in order to keep him from putting his out there.
Smith said that she eventually deleted the sex video.
The man testified in court that he met Smith in the driveway of her family’s home. Smith got into his car, berated him, took out her cell phone, and began recording.
She punched him and pulled a steak knife from her sleeve.
Smith then stabbed the man in the arm and poked him under the eye with the knife.
She ordered him into the backseat of the car, where she forced him to perform a sex act on her, according to his testimony.
The man was not injured in the stabbing. He also testified that Smith took his phone and keys, preventing him from calling for help.
After the forced sex act, Smith proceeded to use the knife to slash up the interior of the car, including the seats and dashboard.
Smith then gave back the man’s keys and he drove off to a nearby gas station, where he called the police.
Smith faced life in prison for two counts of first-degree criminal sexual conduct.
However, the victim asked the judge not to send Smith to prison, according to Smith’s attorney.
In a deal with prosecutors, Smith pleaded no contest to one count of second-degree criminal sexual conduct.
Smith has already served 313 days in jail since her arrest.
Circuit Judge Andre R. Borrello sentenced Smith to 313 days in prison with credit for the 313 days she already served.
In addition, she received 5 years probation and 25 years on the sex offender registry.
She must undergo sex offender treatment, have no contact with the victim, pay restitution $1,000 for the damages done to the victim’s car, and wear a GPS monitor for 1 year.
