A transgender woman was sentenced to 10 years in prison for having a relationship with a 15-year-old girl.
28-year-old Aliea Rose Brown of Bozeman, Montana, pleaded guilty to felony sexual intercourse without consent.
Brown has been in the Gallatin County jail since her arrest. She received credit for 362 days she already served.
Defense attorney Kristen Mull Core had asked the judge for a deferred or suspended sentence for Brown.
She said that Brown has taken responsibility for her actions and that she did not intend to hurt the girl.
Core added that her client “acknowledges that, although she loved the victim, she should have waited to engage in a sexual relationship with her until such time she was mature enough to enter into such a relationship.”
However, the judge disagreed and gave her a 10-year prison sentence because she was already a sex offender.
Brown was convicted having sexual intercourse without consent when she was a juvenile in 2005. At that time, she still identified herself as Albert Brown.
According to court documents, Brown lived together with the victim, her brother, her mother, and her mother’s boyfriend.
Brown admitted that she was in a relationship with the 15-year-old girl but defended her actions saying that she “had the consent of the girl’s mother to date her.”
Brown admitted to having sex with the girl several times.
The girl and her mother also admitted to the relationship despite knowing that she was a registered sex offender.
The mother said that she researched online and believed it was legal for Brown to have a romantic relationship with her daughter as long as they had parental permission.
The mother was also arrested. As part of a plea deal with prosecutors, the mother pleaded guilty to endangering the welfare of children and obstructing a public servant.
She received a six-month suspended sentence and was ordered to complete 20 hours of community service.
